Terms of Service

1. Who we are

Delyst is an email marketing platform operated by eforconection, a company registered in Tunis, Tunisia ("Delyst", "we", "us"). When you subscribe to a paid plan, the transaction is processed by Paddle.com Market Limited as Merchant of Record. Paddle handles billing, tax collection, and invoicing on our behalf and is the counterparty on your receipt. Service delivery and support are provided by eforconection.

2. What the Service is

Delyst provides a web-based platform for designing, sending, and analysing permission-based email campaigns. Features include template building, double opt-in subscription forms, marketing automation, deliverability monitoring (SPF / DKIM / DMARC / BIMI), and an optional AI assistant that answers questions about the account's own data.

3. Your account

You must be at least 18 years old and legally able to enter a contract. You are responsible for the accuracy of the information you provide, for keeping your credentials secret, and for all activity that happens under your account. Notify us immediately at support@delyst.com if you suspect unauthorised use.

4. Subscriptions, billing and renewal

Paid plans renew automatically at the end of each billing cycle (monthly or yearly as selected) unless cancelled beforehand through your account dashboard. Pricing shown on the checkout page is the price you are billed; taxes are added where applicable.

Credit packs are one-time purchases. Unused credits do not expire as long as your account remains active. Credits are consumed by AI-assisted features; usage is visible in real time on the dashboard.

Refunds are governed by our Refund Policy.

5. Acceptable use

Delyst is for permission-based email only. You may only send to recipients who have explicitly opted in to hear from you. The following are prohibited:

  • Sending to purchased, scraped, or harvested lists.
  • Sending without a visible, working unsubscribe link.
  • Content that is illegal, deceptive, harassing, or infringing.
  • Distribution of malware, phishing attempts, or credential harvesters.
  • Promotion of adult services, illegal gambling, or regulated goods without the proper licences in the recipient's jurisdiction.
  • Attempting to reverse-engineer, resell, or impersonate the Service.

We monitor bounce, complaint, and spam-trap rates. Accounts exceeding industry-standard thresholds may be throttled or suspended without notice to protect the shared sending infrastructure.

6. Your content and data

You retain ownership of the subscriber data, templates, and content you upload. You grant us a limited licence to process it solely to operate the Service on your behalf (sending mail, tracking events you have enabled, generating analytics, and serving your own data back to you). We do not sell or share your subscriber data with third parties for their marketing.

Processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Addendum.

7. Service availability

We make reasonable efforts to keep the Service available 24/7 and publish uptime at status.delyst.com. We may perform scheduled maintenance with advance notice, and emergency maintenance without notice when required to protect the integrity of the Service or its users.

8. Suspension and termination

You may cancel at any time from the dashboard. We may suspend or terminate accounts that breach these Terms, especially section 5 (Acceptable use), that fail to pay, or that endanger the deliverability reputation of the shared infrastructure. On termination you can export your data for 30 days; after that the account is permanently deleted as described in the Privacy Policy.

9. Warranties and liability

The Service is provided on an "as is" basis. We disclaim all implied warranties to the maximum extent permitted by law. We do not guarantee specific deliverability rates, inbox placement, or conversion outcomes — those depend on content, sender reputation, and recipient behaviour outside our control.

Our aggregate liability for any claim arising from or related to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost data, business interruption) to the extent allowed by law.

10. Changes to these Terms

We may update these Terms to reflect changes in the Service, the law, or our business practices. Material changes are announced by email and by an in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of Tunisia, without regard to conflict-of-law rules. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Tunis, unless mandatory consumer-protection law in your country grants you the right to bring proceedings locally.
